Tradeyourstuff.co.uk is a website owned and operated by Tradeyourstuff Limited (a registered company in England and Wales, number 6250800).
2. Ordering from us
By placing an order through our site, you warrant that:
(a) You are legally capable of entering into binding contracts; and
(b) For any items which have age restrictions, that you meet these criteria.
3. Buying from Tradeyourstuff
3.1. After placing an order, you will receive an e-mail from us acknowledging that we have received your order. You will then receive an email from us when the item has been despatched. The contract is formed between you (The Buyer) and us from this point in time.
3.2 Please note that you will be buying items that are used pre-played games, traded in by other users of the site. We have a strict acceptance policy and as a result, the games you receive when buying will be of very good quality despite being pre-owned.
3.3 Your order will be fulfilled by the delivery date set out for each of the items. Make note of the delivery despatch times as they are different for certain items. If an order consists of items with different despatch times, we will send the items seperately within the timeframes stated.
3.4 Ownership of items will only pass to you when we have received payment from you. If payment is by the means of trading in other items and selling to us, the ownership only passes to you when we have recieved these items from you and an email notification is received by you stating this.
3.5 The Price of any items bought from us are as quoted on the site, except in cases of obvious error. Prices are liable to change at any time, however you will pay the price agreed in the email confirmation sent to you upon the time of the order.
3.6 Our site is only available to UK residents.
4. Selling to Tradeyourstuff
4.1 The Sell Price is the value you are offered for the item by Tradeyourstuff. You will receive this amount quoted by our site if you send your items in to us within 7 days of making the order. You as the seller will meet the postage costs of sending the items to Tradeyourstuff. If upon receipt of an order, it is found that the postage amount paid is insufficient by you as a seller, you will be contacted and the amount payable to the courier/delivery service you use will be deducted from the total amount to be received by you.
4.2 All items sold to us and sent to us must play perfectly with no obvious signs of damage. If the item sent to us is damaged or defective, we will contact you by return email. You will then have several options - we can return the defective item to you at your cost. This will be at a cost of £1.50 per item. If we do not receive a response within 7 days, we reserve the right to recycle these items on your behalf.
4.3 All items sold to us must include the case, covers, sleeve notes and the manuals/inserts where relevant. If an item is received without the manual, we maintain the right to charge lower the the sell price for that item by 25%. If the games sold to us are missing the case and or covers, we will contact you and will return them to you at the costs stated in 4.2. Alternatively, at your request we will recycle these games for you at no cost.
4.4 All items sold to us must be genuine games. Any pirated, fake or illegal games will not be paid for, we maintain the right to contact the relevant authorities if these are sent to us.
4.5 All Video games consoles sold to us must be PAL region coded consoles. These consoles should include all cables, leads, one controller if relevant, or a stylus (in the case of the Nintendo DS, DS Lite and DSi consoles). These consoles will be tested by us before payment is applied to your account. Any memory cards as standard must be included in the console sold to us. If in any instance, this is not the case, you will be contacted by email and we will offer various recommendations or alternatives to you.
4.6 All responsibility of sending your items to us lie with you as the seller. We recommend you send by trackable means (either recorded or signed delivery) allowing you to claim compensation if the items goes missing in transit. Tradeyourstuff will not be held responsible or held responsible for payment for items not received by us once you have despatched the items. Tradeyourstuff will endeavour to help you in any claims that need to be made to chase compensation for missing items. We also recommend that the items are sent in secure packaging to ensure that they arrive safely to us.
4.7 Once the order has been made, you have a timeframe of 7 days to send the items to us. Tradeyourstuff will contact you by email at several times to see the status of the delivery. If the items are sent after the timeframe of 7 days, Tradeyourstuff maintains the right to pay the sell prices for these items on the date of receipt. This amount will be credited to your account and you will be notified by email.
4.7 Upon receipt of your items, we will process and test these items and you will be notified by email that your account has been credited. Any changes made to the amount credited to your account will be due to reasons mentioned in clause 4 in relation to receipt of defective items or items missing manuals.
4.8 This credit is then available for you to use as currency on our site to buy items from us or alternatively for you to cash out and request payment.
4.9 Payment requests will be handled by cheque and will incur a £1 handling charge to cover postage of this cheque and handling costs.
4.10 You will be informed of the payment being made by return email once you have made the request.
4.11 Tradeyourstuff maintains the right to change the sell price value for items with no notice. Tradeyourstuff will however pay the sell price confirmed in the email sent on the date of the order. In relation to clause 4.7, any items sent after the 7 day window period will have the sell prices as at the date of receipt.
4.12 Tradeyourstuff will maintain the rights to monitor the use of voucher code and cash back schemes. If the item is not received within 10 days after the order or no communication is received, Tradeyourstuff will cancel any cash back awarded to the user through cash back schemes. If and when the item is received subsequent to that, we will apply the cash back you expected to receive to your tradeyourstuff account.
4.13 Tradeyourstuff reserves the right to reject multiple transactions by the consumer. We do not accept multiple copies. If a user aims to circumvent these different price measures by placing multiple orders, we maintain the right to reject these items.We also reserve the right to reject items if they are not meeting the terms stated on the checkout pages and will provide users with the option to have these returned. The option will be provided as per 4.2 for sending these items back.
4.14 Our site is only available to UK residents.
5. Refunds
5.1. When you return an item to us because the item is faulty or defective, we will test the item upon receipt. If the item is indeed defective, we will notify you of your refund by return email within 7 days of receipt of the item. If the item is found to be working, we will notify you by email regarding this and you can choose to re-accept the time at the cost of redelivering the item to you OR you may sell the item to us at the sell price stated on the website in exchange for website credit. Refunds will be for the full amount paid including the delivery price. If the item was bought using credit on your account, the refund amount will be applied to your account as a credit.
6. Our Liability
6.1. We warrant to you that any item purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied.
6.2. Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the item you purchased and any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by all parties at the time your order is accepted by us.
6.3. This does not include or limit in any way our liability:
(a) For death or personal injury caused by our negligence;
(b) Under section 2(3) of the Consumer Protection Act 1987;
(c) For fraud or fraudulent misrepresentation; or
(d) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
6.4. We are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us (such as loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data) however arising.
7. Written Communications
Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly by email. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
8. Entire Agreement
8.1. These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
8.2. We each acknowledge that, in entering into a Contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such Contract except as expressly stated in these terms and conditions.
9. Our Right to Vary any Terms and Conditions
9.1. We have the right to revise and amend these terms and conditions from time to time to reflect changes in payment methods and technology, and market conditions.
9.2. You will be subject to the policies and terms and conditions in force at the time that you order products from us.
